As the two ready for what could be a bitter divorce battle, with custody of daughter Suri Cruise the prize, Holmes could use what she knows about the star as leverage in the case.

Although the two are reported to have a prenuptial agreement that sets out the distribution of assets in the event of a divorce, likely no restrictions exist on what Katie can say or make public about their relationship, Cruise’s personal life or his connections to the Church of Scientology.

The church, a pseudo-religion, is supposedly one of the catalysts that prompted the 33-year-old actress to file for divorce. She reportedly feared that Tom was allowing the church to have growing control over Suri’s life and education. Some reports claim that Holmes even feared Cruise would allow the church to “abduct” Suri.

The church is a closely guarded organization and Katie has been on the inside for the length of her marriage. Although she was raised Roman Catholic, she converted to Scientology after she began dating Cruise in 2005.

The couple married in a lavish Scientology ceremony at the 15th-century Odescalchi Castle in Bracciano, Italy. Before the wedding they were legally married in Los Angeles.

The church has been the subject of much criticism over the years, not only for its secretiveness, but also for the extent of control it exerts over its members. Since Holmes is seeking full custody of her daughter, she must be ready to make the church and its practices central to her case.

That can’t be good for the church, or Cruise.

Rumors have also circulated for years that Cruise is bi-sexual and has had homosexual affairs, much like John Travolta. But the rumors have always been hotly denied. If there is any truth to them, Katie would be in a position to know.

In 2003, Cruise has won $10 million in a case against a gay porn actor. The actor claimed he had an affair with the star and broke up Cruise’s marriage to Nicole Kidman. The gay actor put up no defense and later admitted to a judge that the story was false.

In 2001, Cruise sued Los Angeles-based publisher Michael Davis for $100 million after Davis claimed he had a videotape of Cruise engaging in homosexual acts, according to People.

In a settlement deal, Cruise dropped the suit after Davis retracted his claim and issued a statement saying that Cruise “is not, and never has been, homosexual and has never had a homosexual affair.”

Holmes has had her own issues with tabloid rumors. She filed a $50 million libel lawsuit against Star Magazine last year after a story suggested that she took drugs. The Star wrote a public apology in a subsequent issue and made an undisclosed “substantial” donation to Katie’s charity Dizzy Feet Foundation to settle the case.
