Chris Brown’s alleged assault victim suffered injuries serious enough to warrant felony assault charges, a DC police spokesman said today (Oct 27). R&B singer is in jeopardy of violating his probation and possibly being sentenced to serve some time in jail if convicted.

Brown and his bodyguard Christopher Hollosy, 35, were arrested at 4:30 am today in the District of Columbia, after becoming involved in an altercation with an unnamed victim.

A police report is still unavailable.

Brown, 24, allegedly struck the man in the face at least once, with sufficient force to cause a serious injury. Police said the victim was treated and released from a nearby hospital and the injuries were “non-life-threatening.”

But the alleged attack was violent enough to warrant the more serious charge of felony assault as opposed to simple assault. The difference between the two charges is determined by the extent of the injuries, according to police.

A slap, bruise or “rosy cheek” would likely merit a simple assault charge. But if lacerations or broken bones are involved the charge is more serious, a police source told TheImproper.

The victim told TMZ he as a broken nose that will require surgery. He also said Brown uttered a homophobic slur before hitting him, which means he could also be charged with a hate crime, depending on the evidence.

Under DC law, Brown could face a maximum fine of $3,000 and/or up to three years in jail. But his more immediate problem lies back in California, where he is still serving five years probation for the 2009 assault of then-girlfriend Rihanna Fenty.

A conviction in DC could lead to the revocation of his parole and jail time. He’s already run afoul of his probation twice; once over a dispute involving his community service hours and in a case involving a hit-and-run traffic accident.

Brown allegedly “went ballistic” after his Range Rover rear-ended a Mercedes and the driver asked for his driver’s license and insurance information.

To warrant the more serious charge in DC, the assault must cause “significant bodily injury” and the attack has to be “intentional, knowing, or reckless on the part of the offender,” according to the statute.

“Serious bodily injury” is defined as “bodily injury that involves a substantial risk of death, unconsciousness, extreme physical pain, protracted or obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty,” according to the law.

It’s unknown at the moment what caused the altercation outside a the W Hotel on K Street in Downtown Washington. Brown was hosting a part at a nearby club, Park and 14th, and was scheduled to perform at Howard University.

Brown reportedly got into an argument with the man which ended after Brown allegedly punched him in the face. The other man did not fight back.

The R&B singer will be cooling his heels in jail until at least Monday, when courts reopen and a bond hearing can be scheduled, police said.

He is scheduled to appear before Los Angeles County Superior Court Judge James Brandlin on Nov. 20 for a probation status hearing.
