Miscellaneous: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remaining provisions shall be enforced. The New York Independent failure to act with respect to a breach by you or others does not waive The New York Independent’s right to act with respect to subsequent or similar breaches. The failure of The New York Independent to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. This agreement shall be interpreted in accordance with the laws of the State of California.
5. DMCA Compliance: The New York Independent is fully compliant with the Digital Millennium Copyright Act.
