Donald Trump’s efforts to overturn the election, including talks of declaring martial law, amount to “an act of sedition,” New York Attorney General Letitia James charges.
In an explosive interview on SiriusXM, James told host Dean Obeidallah that Trump’s closed-door White House meeting included a discussion of martial law.

Coupled with his fruitless and false claims of election fraud, the president is crossing the line into criminal behavior.
“The reality is is that this is an act of sedition. This president is engaging in illegality, and the fact that he would even consider martial law is an affront to our values, and to the Constitution,” she said.
Sedition is a felony under U.S. law, punishable by fines and up to 20 years in prison. Anyone who attempts to incite a revolt or violence against the government with goal of overthrowing it could face charges.
Trump met with pardoned felon Michael Flynn, his former National Security Advisor, and lawyer Sidney Powell, who has pushed some of the more outlandish claims of voter fraud.
Flynn has been urging the president to declare martial law in several election swing states and allow the military to re-run the election.
During the meeting, the president allegedly raged at his loyalists for betraying him, and discussed taking extralegal measures to overturn the election, according to published reports.
At one point during the meeting, Trump asked about Flynn’s proposal to impose martial law and engaged in a serious discussion about it. Trump also mulled appointing Powell as a special counsel to investigate the election, according to The New York Times, which broke the story.
“The people have spoken, and he should accept the outcome of the election, as opposed to trying to find fraud where none exists,” James said.
The president’s actions, she continued were “nothing more than a distraction” diverting attention from the coronavirus pandemic and the foundering economy, both due to Trump’s ineptitude.
“This is nothing more than an attempt by President Trump to raise money. It’s fundraising. That’s all that this is. Fundraising. And that’s all that he cares about,” James said.
“He’s in the White House, and he stews on the fact that he’s a loser, and he lost this election, and unfortunately he’s finding it hard to accept. He lost.”
With Trump’s legal options all but foreclosed and the prospect of martial law too outlandish to attempt, some House Republicans have come up with a last-ditch attempt to swing the election to Trump.
They plan to try to use Congress’s tallying of electoral results on Jan. 6 –normally a formality– to upend the will of the voters.
James warned that GOP members of Congress “in all likelihood will again try to circumvent the will of the people, undermine our democracy, and delay or attempt to delay the fact that Vice President Biden and Vice President-elect Harris will soon be sworn in on January 20th.”
The effort is expected to be messy and deeply divisive, but will likely fail, according to The New York Times.
Constitutional scholars and even members of the president’s own party say the effort is all but certain to fail.
The Democrat-controlled House and GOP-controlled Senate would both have to agree to disqualify the results, an outcome that is nearly impossible. Senate President Mitch McConnell has pronounced the effort a “dead dog.”
